ECONOMIC AND LEGAL ENVIRONMENT (BL3DR004) The relationship between the administrative and economic world is complex and current events lead us to wonder about the link between public law and the economy. Many questions arise : should law constitute a framework for the economy (to help or subsidize economic activity) ? Why does the administrative world reject state intervention in some cases and demand it in others ? The aim of this course is not to answer these questions, but rather to provide some basis for reflection. At the end of this course, students will master the global organization of the French state, be him decentralized or devoluted. They will understand the definition of a state company, its different shapes, its organization and the different stakes at hand (privatization, community law.). The course is in line with the TAO concept : Tonicity because it deals with present-day issues which are going to deeply modify the relationship between law and economy. Authenticity because the course will be adapted to the practical expectations of business school students. Open-mindedness because lessons are oriented towards the international world (specifically the influence of the European Union).
This course deals with the different methods of state intervention in the economy as well as their justification. It is divided into two parts. The first part deals with the identification and organization of the different public players and will therefore be preceded by a study of state administration. This study will be contextualized by a study of the important developments of state administration's organization (decentralization, relocation, influence of community law,...). The second part will deal with, on the one hand, direct state intervention in the economy (public corporations, state assistance,...), and on the other hand with its indirect intervention, its regulating role which tends to prevail over its intervention role (regulation and control of competition).
